5.5 Refunds and Cancellations

Due to the perishable nature of food products, all sales are generally final. We will review each complaint on a case-by-case basis and, at our sole discretion, may offer a replacement, store credit, or refund. GREEN LANTERN PIZZA DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. GREEN LANTERN PIZZA DOES NOT WARRANT THAT THE RESULTS OBTAINED FROM THE USE OF THE SITE WILL BE ACCURATE OR RELIABLE.

We make no representation or warranty regarding the accuracy, reliability, completeness, timeliness, or suitability of any information or content on the Site. Menu item descriptions, images, and nutritional information are provided for informational purposes only and may not reflect exact products served. Actual products may vary.

To the fullest extent permitted by applicable law, Green Lantern Pizza disclaims all warranties, express or implied, in connection with the Site and your use thereof.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FEDERAL AND STATE LAW, INCLUDING BUT NOT LIMITED TO THE LAWS OF THE STATE IN WHICH GREEN LANTERN PIZZA OPERATES, IN NO EVENT SHALL GREEN LANTERN PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, PERSONAL INJURY, PROPERTY DAMAGE, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your use or inability to use the Site or its services
• Any product or order placed through the Site
• Unauthorized access to or alteration of your transmissions or data
• Any conduct or content of any third party on the Site
• Any errors, mistakes, or inaccuracies of content
• Personal injury or property damage resulting from your use of the Site

IN NO EVENT SHALL GREEN LANTERN PIZZA'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE USE OF THE SITE OR THESE TERMS EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO GREEN LANTERN PIZZA IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN THEIR ENTIRETY. IN SUCH CASES, LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE STATE LAW.

8. Indemnification

You agree to defend, indemnify, and hold harmless Green Lantern Pizza, its officers, directors, employees, agents, licensors, service providers, contractors, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Site or our services
• Your violation of any applicable law, rule, or regulation
• Your violation of any rights of any third party, including intellectual property rights or privacy rights
• Any content or information you submit, post, or transmit through the Site
• Any misrepresentation made by you

Green Lantern Pizza reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate fully with our defense of such claims. You agree not to settle any such matter without our prior written consent.

9. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Green Lantern Pizza's principal place of business is located, without regard to its conflict of law provisions.

To the extent that any lawsuit or court proceeding is permitted under these Terms, you and Green Lantern Pizza agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in the state of Green Lantern Pizza's principal place of business for the purpose of litigating all such disputes. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

These Terms shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded.

10. Dispute Resolution

10.1 Informal Resolution

Before filing any formal legal claim, Green Lantern Pizza encourages you to contact us first to seek an informal resolution. We will attempt to resolve the dispute informally within thirty (30) days of receiving your written notice.

10.2 Binding Arbitration

If we are unable to resolve a dispute informally within thirty (30) days, both parties agree that any dispute, claim, or controversy arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined exclusively by binding arbitration in accordance with the rules of the American Arbitration Association ("AAA") or JAMS, as mutually agreed upon by the parties.

The arbitration shall take place in the state of Green Lantern Pizza's principal place of business, or by telephone or videoconference if mutually agreed. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

10.3 Class Action Waiver

YOU AND GREEN LANTERN PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING. Unless both you and Green Lantern Pizza agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

10.4 Exceptions

Notwithstanding the above, either party may seek emergency equitable relief before a court of competent jurisdiction in order to maintain the status quo pending arbitration. Either party may also bring a claim in small claims court for disputes within the applicable jurisdictional limits.

10.5 Consumer Protection Rights

Nothing in these Terms limits or waives any rights you may have under the Federal Trade Commission Act (FTC Act), applicable state consumer protection statutes, or any other consumer protection laws. If you are a California resident, you may also have rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) with respect to your personal information. 11. Term and Termination

These Terms are effective as of the date you first access or use the Site and shall remain in full force and effect for as long as you continue to use the Site or maintain an account with us, unless terminated earlier in accordance with these Terms.

Green Lantern Pizza reserves the right, in its sole discretion, to suspend or terminate your access to the Site or your account at any time, with or without cause, and with or without notice, including but not limited to situations where:

• You have violated any provision of these Terms
• Your conduct poses a risk to Green Lantern Pizza, other users, or third parties
• We are required to do so by law or regulation
• We decide to discontinue or substantially modify the Site or services
